BOSTON - Loverboy Inc., a provider of sparkling hard teas and premium craft cocktails in forty-four states across the country, has amicably resolved its dispute with Night Shift Distributing. In 2019, Night Shift and Loverboy announced a partnership under which Night Shift agreed to distribute Loverboy's products in Massachusetts. In Fall 2020, Loverboy exercised its contractual right to terminate the relationship. On January 12, 2021, Massachusetts Governor Charlie Baker signed Massachusetts General Laws ch. 138, Section 25E1/2 into law. This new law permits certain brewers to terminate their relationship with distributors in Massachusetts provided the brewer pays the distributor reasonable compensation for the brand rights. Loverboy and Night Shift disagreed on the legal implications of this new law on their written agreement. Loverboy announces today that it has amicably resolved its dispute with Night Shift. The parties agreed by contract to terminate their relationship for convenience upon 30 days' notice. Loverboy exercised that right and terminated Night Shift prior to the enactment of Section 25E1/2.
